1. Provider and scope
gspart is a service provided by AUTOMATA – Jan-Michael Waiser (details in the Legal notice). These terms apply to the use of the gspart app and website and to the “gspart Premium” subscription. The General Terms and Conditions of AUTOMATA apply in addition; in the event of any conflict, these terms for gspart take precedence.
2. What gspart does – and what it doesn’t
- gspart calculates in which shop near you your entire shopping is likely to cost the least and shows an approximate total for it.
- This is based on publicly available online prices of the supermarket chains. Prices in the shop, special offers, availability, branches and opening hours may differ. If an item is not listed online, we calculate using a usual price.
- The totals and the “savings” are estimates. We give no guarantee that you will pay or save the amount shown.
- gspart is independent and has no connection with the supermarket chains.
- The analysis of receipts (spending, savings) is an aid to help you keep an overview, not bookkeeping.
3. Free use
Use is free of charge. Before each price comparison, gspart shows 10 seconds of advertising. There is no entitlement to any particular feature or to constant availability; we endeavour to ensure uninterrupted operation.
4. gspart Premium
- Service: gspart without ads, straight to the result. All other features are the same as in the free version.
- Price: 2,49 € per month or 19,99 € per year, in each case incl. 20% VAT. Payment is made in advance via Stripe.
- Term: The subscription renews automatically for a further month or year respectively if you do not cancel.
- Cancellation: at any time with effect from the end of the current term – in the app under Profile → “Manage or cancel subscription” or via Cancel contracts here. Premium remains active until the end of the paid period.
- Price changes apply to existing subscriptions only after timely notice by email; you may then cancel beforehand.
- Devices: You may use Premium with your email address on your own devices. Passing it on to others is not permitted.
5. Right of withdrawal for consumers
As a consumer, you may withdraw from the Premium contract within 14 days of the conclusion of the contract without giving any reason – most easily via Withdraw from contract or by email to office@automata.at. If you expressly requested that Premium begin immediately, in the event of withdrawal you pay the proportion corresponding to the time used up to that point. We will refund the remainder within 14 days using the same means of payment.
6. Fair use
Please use gspart only for your own shopping. Automated mass queries, extracting the price data and attempts to circumvent the advertising or security features are not permitted. In the event of misuse, we may restrict access.
7. Liability
We are liable for damage only in cases of intent and gross negligence; this does not apply to personal injury, nor to the extent that mandatory consumer law provides otherwise. We accept no liability for price differences in the shop or for the content of advertisers and linked websites.
8. For advertisers
We allocate advertising slots in gspart to businesses by individual agreement (period, price per day, image or video with link). Advertisers are responsible for their own content. Enquiries to office@automata.at.
9. Applicable law and disputes
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you retain the mandatory protective provisions of your country of residence and your statutory place of jurisdiction.
